4. You as the investor decide
Each individual property that meets the stringent investment criteria laid down by the ZBI Group is first presented to the investors by the fund management. This so-called “first look” right ensures that all real estate acquired by the ZBI Group is first offered to the stakeholders. The investors themselves or an investor advisory board elected by them meet to decide on purchase and sale of fund real estate.
The “first look” right gives the investors the last word on buying and selling the properties.
5. The ‘Client First Principle’
The success of the initiator ZBI is essentially performance based in that it is only when the prospectus-based capital account interest of 7.5 per cent and repayment of the invested capital (plus the five-per-cent agio) are fully assured that ZBI begins to share in sales proceeds. This ensures that the interests of the investors on the one hand and those of the Initiator on the other are evenly balanced. All profits remaining after a sale are equally shared between the investors and the ZBI Group.
First the investors will receive the returns pledged in the prospectus and only then will the ZBI Group receive its shares of the capital gain.
6. Refund of the agio
Likewise, the handling of the five-percent agio is to the advantage of the investors as it is treated on a par with limited partner’s capital for the purposes of preferred profit allocation to the investors and is refunded when the investment company is dissolved.
